By accessing and using the services of triumpfepb B.V. ("Company," "we," "our," or "us"), you ("Client," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and triumpfepb B.V., a company registered in the Netherlands under registration number 27593684.
If you do not agree to these Terms, you may not access or use our services. By engaging our construction services, visiting our website, or communicating with us regarding potential projects, you acknowledge that you have read, understood, and agree to be bound by these Terms.

triumpfepb B.V. provides general contracting and construction services, including but not limited to:

As a client of triumpfepb B.V., you agree to:
All quotations provided by triumpfepb B.V. are estimates based on the information available at the time of quotation. Final pricing may vary based on actual site conditions, material costs, and scope changes. Quotations are valid for 30 days unless otherwise specified.
A separate written contract will be executed for each project, detailing specific terms, scope of work, timelines, payment schedules, and other project-specific conditions. In case of conflict between these Terms and a project contract, the project contract shall prevail.
triumpfepb B.V. warrants that all work will be performed in a workmanlike manner in accordance with industry standards and applicable building codes. We provide a warranty on our workmanship for a period of 12 months from project completion, unless otherwise specified in the project contract.
This warranty does not cover normal wear and tear, damage caused by misuse, neglect, or acts of nature, or defects in materials not supplied by us. Manufacturer warranties on materials and equipment remain in effect as provided by the respective manufacturers.
To the maximum extent permitted by Dutch law, triumpfepb B.V.'s total liability for any claims arising from or related to our services shall not exceed the total amount paid by the Client for the specific project giving rise to the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, business interruption, or loss of data, regardless of the theory of liability.
triumpfepb B.V. shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labour disputes, government actions, supplier failures, or material shortages.
All designs, plans, specifications, and other intellectual property created by triumpfepb B.V. in connection with your project remain our property unless specifically transferred in writing. Clients receive a non-exclusive licence to use such materials solely for the intended project.
Our collection and use of personal information is governed by our Privacy Policy, which complies with the General Data Protection Regulation (GDPR) and Dutch privacy laws. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.
Either party may terminate a project contract upon written notice if the other party materially breaches these Terms or the project contract and fails to cure such breach within 14 days of written notice. Termination does not relieve either party of obligations incurred prior to termination.
triumpfepb B.V. maintains appropriate professional liability, general liability, and workers' compensation insurance. Proof of insurance coverage may be provided upon request. Clients are responsible for maintaining adequate property insurance for their premises.
All work will be performed in compliance with applicable Dutch building codes, safety regulations, and industry standards. Clients must ensure that the work site is safe and accessible for our personnel and equipment.
Any disputes arising from these Terms or our services shall first be addressed through good faith negotiations. If resolution cannot be achieved, disputes shall be resolved through binding arbitration under the rules of the Netherlands Arbitration Institute (NAI), or through the competent courts in Utrecht, Netherlands.
These Terms shall be governed by and construed in accordance with the laws of the Netherlands. Any legal proceedings shall be conducted in the Dutch language and subject to the jurisdiction of Dutch courts.
triumpfepb B.V. reserves the right to modify these Terms at any time. Changes will be effective upon posting on our website. Continued use of our services after such changes constitutes acceptance of the modified Terms. Material changes will be communicated to existing clients.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
These Terms, together with any applicable project contracts and our Privacy Policy, constitute the entire agreement between triumpfepb B.V. and the Client regarding our services and supersede all prior agreements and understandings.
